My employment contract is due to end on November 21, 2026. However, my employer has given me a two-month notice stating that my last working day will be September 9, 2026. Am I entitled to receive my salary until the original contract end date? If not, can Saudi Labor Law help me?
Answer
The answer depends on the type of employment contract and the legal reason for the termination.
If you have a fixed-term contract, your employer generally cannot terminate it before the agreed expiry date without a legally valid reason under the Saudi Labor Law.
If your employer ends the contract early without a lawful reason, you may be entitled to compensation. This compensation may include:
- Salary or compensation for the remaining period of the contract (subject to the contract terms and Saudi Labor Law).
- End-of-service benefits (if applicable).
- Payment for any unused annual leave.
- Any other contractual entitlements.
If the employer has a valid legal reason for termination under the Saudi Labor Law, different rules may apply.
Can the Employer Simply Give Two Monthsโ Notice?
Giving notice alone does not automatically remove the employerโs obligations under a fixed-term contract.
A notice period is important, but if the contract is terminated before its expiry without legal justification, the employee may still have the right to claim compensation.
Can Saudi Labor Law Support Me?
Yes.
If you believe your contract has been terminated unlawfully, you can:
- Discuss the matter with your employer or HR department.
- File a labor complaint through the Qiwa or Musaned platform (where applicable), or the Ministry of Human Resources and Social Development (MHRSD).
- If the dispute is not resolved, it may be referred to the Saudi Labor Court for a legal decision.
Important Note
Every case is different. Your legal rights depend on factors such as:
- Whether your contract is fixed-term or indefinite.
- The exact wording of your employment contract.
- The reason for termination.
- Whether the employer has complied with the Saudi Labor Law.
For this reason, employees should review their employment contract carefully before accepting an early termination.
